ACCEPTABLE USE POLICY

  1. Introduction
    1. This website (www.plumbapp.co.uk) (the Website) and the app 'Plumb App UK' (the App) are owned and operated by Plumb App UK Limited ("we", "us" and "our") whose contact details are listed at the end of this policy.
    2. Please read this policy carefully. By using our Website and/or App, you confirm that you accept this policy and that you agree to comply with it. If you do not agree to this policy, you must not use our Website or our App.

  2. Changes to this policy and other policies which apply
    1. We may change this policy from time to time. This policy is effective from 27 October 2021 and replaces any previous versions. You will be deemed to agree to this policy if you continue to use our Website or App following this date. If you do not agree to this policy, you must not use our Website or App.

  7. For the avoidance of doubt, for any Contribution in the form of video content:
    1. Video content should be uploaded only to review products, give feedback, demonstrate industry related work or provide insights into projects you are working on.
    2. You must tell us immediately, if you upload a video containing any of the following: criminal material (relating to terrorism, sexual exploitation of children, child pornography, racism and xenophobia), unclassified or unclassifiable videos, videos rated R18 or suitable for R18 rating and other material that might impair the physical, mental or moral development of persons under the age of 18 (restricted material).
    3. You must not upload a video containing harmful material.
    4. You must not upload a video containing advertising material.
    5. Any video you upload must not:
    6. prejudice respect for human dignity;
    7. include or promote discrimination based on sex, racial or ethnic origin, nationality, religion or belief, disability, age or sexual orientation;
    8. encourage behaviour prejudicial to health or safety;
    9. encourage behaviour grossly prejudicial to the protection of the environment;
    10. cause physical, mental or moral detriment to persons under the age of 18;
    11. directly exhort such persons to purchase or rent goods or services in a manner which exploits their inexperience or credulity;
    12. directly encourage such persons to persuade their parents or others to purchase or rent goods or services;
    13. exploit the trust of such persons in parents, teachers or others; or
    14. unreasonably show such persons in dangerous situations.
    15. You must use the functionality provided on our site to declare whether, as far as you know or can reasonably be expected to know, any video contains advertising.
  8. Copyright
    1. By submitting a Contribution to the App or Website, you agree to grant Plumb App UK Limited a non-exclusive licence to use that Contribution. Although you will still own the copyright in your Contribution, Plumb App UK Limited will have the right to freely use, edit, alter, reproduce, publish and/or distribute the material contained in your Contribution. This licence will be free of charge, perpetual and capable of sub-licence. Plumb App UK Limited may exercise all copyright and publicity rights in the material contained in your Contribution in all jurisdictions, to their full extent and for the full period for which any such rights exist in that material.
    2. Please also note that, in accordance with the Content Standards set out at clause 6 above, you must ensure that your Contribution does not infringe any copyright, database right or trade mark of any other person. By submitting your Contribution to the App or Website, you are warranting that you have the right to grant Plumb App UK Limited the non-exclusive copyright licence described above.
    3. If you are not in a position to grant such a licence to Plumb App UK Limited, please do not submit the Contribution to the App or Website.
  9. Functioning of our Website and App
    1. We may update and change our Website or App from time to time. We will try to give you reasonable notice of any major changes.
    2. We do not guarantee that our Website or App, or any content on either, will always be available, uninterrupted or error-free.
    3. We are entitled, without liability, to suspend or withdraw the Website or App for repair, maintenance, improvement or any other technical reason. We will try to give you reasonable notice of any planned suspension or withdrawal.
    4. We do not guarantee that our Website or App will be secure or free from bugs or viruses. You should use your own virus protection software.

    1. You must treat your Plumb App Member Login (including: user identification code, password or any other piece of information as part of our security procedures) as confidential. You must not disclose it to any third party.
    2. We have the right to disable your member login at any time, if in our reasonable opinion you have failed to comply with any of the provisions of this policy.
    3. If you know or suspect that anyone other than you knows your member login details, you must promptly notify us at support@plumbapp.co.uk.
  14. English law
    1. This policy shall be governed by English law and any disputes (contractual and non-contractual) will be decided at the exclusive jurisdiction of the courts of England and Wales.
  15. General
    1. Any failure by either party to exercise or enforce any right or provision of this policy does not mean this is a "waiver" (i.e. that it cannot be enforced later).
    2. We can transfer our rights and obligations under this policy to any third party, provided this does not adversely affect your rights under this policy.
